PART IV - PROSECUTION AND REPRESENTATION



Section 65. Syarie Prosecutor and Religious Enforcement Officer.

(1) His Royal Highness the Sultan shall on the advice of the Majlis appoint a person who is qualified to be a Judge of the Syariah High Court to be the Chief Syarie Prosecutor.

(2) The Chief Syarie Prosecutor shall have powers exercisable at his discretion to prosecute, conduct or not to continue any proceedings for an offence before a Syariah Court.

(3) The Majlis may appoint fit and proper persons from among the members of Pahang State Syariah Officers Service or the Public Service to be the Deputy Syarie Prosecutor who shall act under the general control and direction of the Chief Syarie Prosecutor and may exercise all or any of the right and powers vested in or exercisable by the Chief Syarie Prosecutor under any written law except any rights or powers that are expressly provided to be exercised by the Chief Syarie Prosecutor personally.

(4) The Majlis may appoint Religious Enforcement Officers to assist in the investigation of offence under this Enactment or under any other written law relating to offences under Hukum Syarak.
