PART VII - OFFENCES



Section 115. Printing of religious matter and others.

(1) Whoever prints, publishes, sales or exhibits for sales or gratuituously or in any manner, disseminates or distributes any book, magazines, documents or letters which contain any teaching, fatwa or opinion which is contrary to the Hukum Syarak or any fatwa which has been issued in this State by or on behalf of the Majlis, shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding four thousand ringgit or to imprisonment for a term not exceeding two years or to both.

(2) Where any person has in his keeping or control books, magazines, documents or letters as referred to in subsection (1) and if found in such condition as to give reason to suspect that the books, magazines, documents and leiters are for dissemination or distribution or for sale, such things shall be deemed to be in his control or keeping or with him in order to be disseminated, distributed or sold.

(3) In the absence of other evidence to the contrary, where five books or magazines or more are found or five pieces or more with a similar content of the documents or letters are found, it is sufficient to raise the suspicion that is referred to in subsection (2).


(4) The Court shall issue an order in regard to all the books, magazines, documents and letters referred to in subsections (1) and (2) that they be destroyed or be subject to any other suitable order, whether a prosecution is brought or not.
