PART IX - OFFENCES



Section 162. Wrongful teachings.

(1) Whoever shall teach or publicly expound any doctrine or perform any act relating to the Religiom of Islam contrary to Hukum Syara’ shall be guilty of an offence and shall on conviction be liable to a fine not exceeding five hundred ringgit or to imprisonment for a term not exceeding six months or to both.

(2) If, during the trial of any charge under this section any question shall arise which requires determination on the authority of a certain fatwa that has not been recognised or made in the State the Court shall refer such question in writing to the Majlis and the Court shall be bound by whatever decision of the Majlis on the question referred thereto.

(3) Whenever a reference is made under subsection (2) the Court may postpone the hearing of the case until the decision of the Majlis is received.

(4) All such wrongful teachings for the purpose of subsection (1) if in writing, the Court shall order their forfeiture with the direction that they be destroyed or with whatever direction as may be appropriate whether there shall be prosecution of any person or not.
