PART III - JURISDICTION OF SYARIAH COURT
Section 20. Inheritance Certificate.
(1) If in the course of any proceedings of a civil court or an authority or a person interested in the administration or distribution of an estate which ought to be distributed according to the Hukum Syarak, such civil court or authority or person interested may request the court of a Kadi to issue a certificate to be called the "Inheritance Certificate" regarding the distribution of the estate and the persons entitled thereto.
(2) The certificate as stated in subsection (1) shall be issued by the Court of the kadi based on the facts submitted by the civil court, authority or person interested and any facts obtained from its own investigation:
Provided that if the Court of the Kadi feels it appropriate, it can before issuing the certificate, hear any party, regarding any relevant matter, either on oath or affirmation.
(3) In any matter of exceptional difficulty, the Court of a Kadi may refer the matter to the Majlis to obtain its opinion and shall when the Majlis has given its opinion, certify in accordance therewith.
