PART XII - COURT

Section 66. The Special Syariah Trial Court.

(1) All prosecutions under this Enactment shall be tried by the Special Syariah Trial Court and heard by a panel of three Judges appointed by the Chief Syarie Judge, two of whom from among the Judges of Syariah High Court and another person of either a High Court Malaya Judge retired or serving or a person qualified and suitable to be appointed as a Judge of High Court Malaya. If he is to be appointed from a non serving judge the appointment shall be made by the Duli Yang Maha Mulia Sultan acting on the advise of the Menteri Besar.

(2) The panel of Judges shall be headed by the Judge so appointed by the Chief Syarie Judge.

(3) The decision of the Special Syariah Trial Court may be by simple majority.

(4) Appeal from the decision of the Special Syariah Trial Court shall lie to the Special Syariah Court of Appeal.
