PART IV - MARRIAGE, DIVORCE AND RUJUK
Section 67. Divorce by Talak.
(1) A husband may divorce his wife in accordance with Hukum Syara' provided that every such divorce shall be registered and the husband shall complete certain prescribed forms which shall be despatched to the Kadi within fifteen days such divorce.
(2) Upon receipt of the said forms from a husband who intends to divorce or has divorced his wife the Registrar shall, for the purpose of effecting a reconciliation, investigate the applicant and his wife.
(3) Every husband and wife intending to have a divorce may together appeal in person before the Registrar of the area in which they reside. If at that time the wife is outside the area or in another state, the Registrar shall communicate with the wife either through the Registrar in that other area or the Kadi in that other State.
(4) If the husband and wife cannot be reconciled, divorce shall then be effected in accordance with subsection (1):
Provided that all rights as between husband and wife shall first be determined by consent of both parties in the presence of the Registrar.
(5) In the case of divorce being effected under subsection (4) the husband shall pay by way of advance to the Registrar a sum not less than one month personal expenses unless the divorce does not require the husband to provide maintenance.
