PART III - SYARIAH APPEAL COURT



Section 5. Appointment of Syariah Appeal Court Judges

(1) His Royal Highness the Sultan, on the advice of the Majlis and the Chief Syarie Judge, may appoint not less than three and not more than seven Muslims to constitute a standing panel of Syariah Appeal Court Judges.

(2) Every appointment under subsection (1) shall published in the Gazzette.

(3) Judges of the Syariah Appeal Court appointed not from the general public service of the State shall be paid such remuneration with the consent of His Royal Highness the Sultan on the advice of the Majlis.

(4) A person who is appointed under subsection (3) shall hold office for a period of three years and is eligible for reappointment.

(5) A person, who immediately before the commencement of this section, was holding the post of Syariah Appeal Court Judge and was performing judicial functions shall, on the commencement of this section, continue to hold office as Judges of Syariah Appeal Court Judge as if he had been appointed under subsection (1).
