PART VIII - QISAS
Section 31. Pardon.
The wali may at any time before the punishment of death as the qisas punishment is executed, pardon the offender whether, with or without a diyat; and if the pardon is with a diyat, this shall be paid either in a lump sum or by instalments within a period of three years from the date of the final judgement, and if in the meantime the offender dies, the diyat shall be recoverable from his estate. If the offender does not have any estate, it shall be recoverable from Baitulmal.
