PART IV - GENERAL PROCEDURE

Section 19. Peguam Syarie.

(1) The Kadi Besar may permit any suitable person upon his application to be a Peguam Syarie.

(2) For the purpose of subsection (1) of this section, the following persons are deemed to be eligible and competent in matters pertaining to Hukum Syarak:

(a)

the holder of a degree in Islamic law from any institution of higher learning recognised by the Government;

(b)

a person whom has served as a Kadi for a period of not less than ten years.

(3) Peguam Syarie shall not appear and plead in any court on behalf of any party in any proceedings unless a certificate in writing issued by the Kadi Besar and on payment of the prescribed fees. Such certificate shall be issued annually and signed by the Kadi Besar.

(4) The Court may allow Government officers in their official capacity to appearn and plead in the Court on behalf of any party in any proceedings.
