ENACTMENT NO. 3 OF 2002 CONTROL OF ISLAMIC RELIGIOUS SCHOOLS (MALACCA) ENACTMENT 2002
PART III - REGISTRATION OF RELIGIOUS SCHOOLS
Section 7. Registration.
(1) Upon receipt of an application together with the documents and information required under section 6, if any, the Registrar shall, after such inquiry as he may think necessary, consider the application whether to approve or refuse the application.
(2) In determining whether to grant an approval to register a religious school or not, the Registrar shall consider the following matters:
(a) the suitability of the religious school or its building on the grounds of health and safety;
(b) the suitability of the persons constituting the Board to manage the religious school;
(c) financial sources to maintain the religious school;
(d) the need to provide another religious school in the area in which it is proposed to open the religious school; or
(e) any other reasons which in the opinion of the Registrar is necessary to successfully open a religious school.
(3) The Registrar may refuse to register a religious school if he is satisfied that-
(a) the religious school does not satisfy the prescribed standards of health and safety;
(b) the religious school is used or likely to be used for a purpose detrimental to the interest of the public or the pupils;
(c) the name under which the religious school is to be registered is, in his opinion, undesirable;
(d) the existing religious educational facilities are already adequate in the area in which it is proposed to open the religious school;
(e) a statement which was false or misleading in a material particular has been made in or in a connection with the application for registration;
(f) the person applying for the registration of the religious school fails or refuses to comply with any of the conditions imposed by the Registrar under this Enactment; or
(g) the person appointed to be the chairman of the Board or head teacher or principal is not a fit and proper or responsible person to act as chairman, head teacher or principal, as the case may be.
(4) If the Registrar approves an application under subsection (1), he shall immediately register the religious school and the instrument of management of the school and issue a certificate of registration to the chairman of the Board or any other person responsible for the management of the religious school.
(5) The chairman of the Board or any person responsible for the management of the religious school shall cause a copy of the certificate of registration to be exhibited in a conspicuous part of the premises of the religious school.
(6) Any person who contravenes subsection (5) commits an offence.
(7) The Registrar may imposed-
(a) such condition precedent as he deems fit; or
(b) such directions from time to time after registration.
(8) If the Registrar refuses an application under subsection (1), he shall immediately notify the applicant is writing of his refusal, specifying in the notice the grounds of the refusal.
