Section 87. Way to give evidence.
(1) In civil cases, evidence shall be given by the plaintiff and the defendant. The defendant who denies the claim shall be asked to take oath according to Hukum Syarak.
(2) (a) When the defendant takes the oath, the claim of the plaintiff is rejected in toto.
(b) If the defendant refuses to take the oath, the Court may ask the plaintiff to take the oath and after taking the oath the plaintiff’s claim shall be accepted.
(3) In criminal cases, evidence shall be given by the prosecution and by the accused except when the accused pleads guilty.
