PART XIX – EXECUTION
Section 154. Sale.
Where any property is sold in execution -
(a) the sale shall take place between 8.00 a.m. and 4.00 p.m.
(b) the sale, save as provided in paragraph (f) of this section, shall be by public auction without reserve, and every sale shall be paid for in cash before the completion of the auction; no person having any duty to perform in connection with the sale or execution may bid or otherwise directly or indirectly acquire or attempt to acquire any interest in the property sold, but the judgment creditor may bid, unless the Court shall otherwise order, and, with the prior leave of the Court, the purchase money and the amount due on the judgment may be set-off against one another, and the judgment shall be deemed to be satisfied wholly on pro tanto accordaingly;
(c) notice of the day, hour and place of the sale and of the property to be sold shall be posted at the Court house and at the place of the sale not less than 6 days before the sale;
(d) negotiable instrucments and other securities may be sold without auction through the agency of a recognized stock and share broker; the sale shall not be subject to the prior approval of the Court;
(e) every sale shall be executed and completed by Court;
(f) the Court may in any case for sufficient reason order sale in a manner not in accordance with this section.
