Section 102. Prohibition order by Court

(1) Notwithstanding the provisions of section 91, the Court may, where it considers it necessary so to do, make an order prohibiting the father of a minor or the father’s father or their respective executors or their respective executors’ executors from -

(a) selling, charging, mortgaging, exchanging, or otherwise parting with the pos session of any movable or immovable property of the minor; or

(b) leasing any land belonging to the minor for a term exceeding one year, without the prior leave of the Court.

(2) Any disposal of a minor’s property in contravention of the order may be declared void, and on such declaration the Court may make such order as appears requisite for restoring to the minor’s estate the property disposed of.

(3) The Court shall not make any order under subsection (2) unless it is necessary or advisable in the interests of the minor.
