Chapter XV - OF SUSPENSION, REMISSIONS AND COMMUTATIONS OF SENTENCES



Section 134. Power to suspend or remit sentences.

(1) When any person has been sentenced to punishment for an offence, His Royal Highness the Sultan (acting in accordance with the provisions of Article 42 of the Laws of the Constitution of Kedah Darulaman and Article 42 of the Federal Constitution) may at any time, without conditions, or upon any conditions which the person sentenced accepts, suspend the execution of his sentence or remit the whole or any part of the punishment to which he has been sentenced.

(2) Whenever an application is made to His Royal Highness the Sultan for the suspension or remission of a sentence His Royal Highness the Sultan may require the convicting Kadi Besar or Kadi to state his opinion as to whether the application should be granted or refused and such Kadi Besar or Kadi shall state his opinion accordingly.

(3) If any condition on which a sentence has been suspended or remitted is, in the opinion of His Royal Highness the Sultan, not fulfilled, His Royal Highness the Sultan may cancel such suspension or remission;

whereupon the person in whose favour the sentence has been suspended or remitted may, if at large, be arrested by any police officer or Penyelia Agama without warrant and remanded by a Kadi to undergo the unexpired portion of the sentence.

(4) Nothing herein contained shall be deeme to interfere with the right of His Royal Highness the Sultan to grant pardon, reprieves, respites or remissions of punishment.
