PART VI – SERVICE
Section 43. Substituted service.
(1) Where the Court is satisfied that a party who has not given any address for service was, at the adte of the summons or other documents to be served, resident within abah and there is person to believe that he is keeping out of the way for the purpose of avoiding service, or that for any sufficient reason the summons or other document cannot be served in the ordinarily way, the Court any other the summons or other documents to be served by affixing a copy thereof in some conspicuous place in the Court house and also upon some conspicuous part of the building in which the party to be served is known to have last resided, or in any other manner as the Court thinks fit.
(2) The Court may also, in any case failing within the terms of sub-section (1), make an order for service by advertisement in such local newspaper or newspaper as the Court may think fit.
(3) Substituted service shall be as effectual as personal service.
(4) In cases of substituted service the Court shall fix the time of appearance in Court for the relevant party where necessary.
(5) o order for substituted service shall be made in respect of -
(a) a subpoena; or
(b) any document initiating proceedings for the arrest or committal of any person.
