PART IV - PENALTIES AND MISCELLANEOUS PROVISIONS RELATING TO THE SOLEMNIZATION AND REGISTRATION OF MARRIAGES



Section 40. Correction of errors

(1) If the Registrar is satisfied by statutory declaration or otherwise that any entry relating to a marriage is erroneous in form or substance, he may, in the presence of the persons married, or, if they are absent, in the presence of two credible witnesses, correct the error by ruling through the entry in the local Register of Marriages to be corrected in the same manner.

(2) The Register shall sign and date the correction made in the certificate of marriage and the local Register of Marriages.

(3) Every entry made under subsection (1) shall be attested to by the witnesses in whose presence it was made.

(4) A certified copy of the correction shall be sent forthwith to the Chief Registrar for a similar correction to be made in his Register of Marriages.
