PART III - SYARIAH COURTS



Section 54. Appointment and composition of the Syariah Appeal Court.

(1) His Royal Highness the Sultan, on the advice of the Majlis Who shall first consult the Chief Syarie Judge, shall appoint annually not more than seven male Muslims who in the opinion of His Royal Highness are fit and proper to constitute a standing panel of members of the Syariah Appeal Court and such appointment shall be published in the Gazette.

(2) An appeal in the Syariah Appeal Court shall be heard and disposed of by a Chairman and two Syariah Appeal Court Judges as determined by the Chief Syarie Judge.

(3) The Chief Syarie Judge shall be the Chairman of each proceeding of the Syariah Appeal Court and shall select for each proceeding two of the members of the standing panel to constitute the quorum of the Syariah Appeal Court and all three persons who constitute the quorum shall be deemed to be Syariah Appeal Court Judges for the purposes of this Enactment.

(4) Where for any reasons the Chief Syarie Judge is unable to preside over the Syariah Appeal Court, he shall inform His Royal Highness the Sultan who shall appoint one from amongst the members of the standing panel to preside over such Court.

(5) Where for any reasons a Syariah Appeal Court Judge selected under subsection (3) is unable to perform his duties, he shall inform the Chief Syarie Judge who shall select one from amongst the members of the standing panel to replace such Syariah Appeal Judge.
