PART II - OFFENCES
Section 35. Unlawful issue of fatwa.
(1) Any person who either verbally or in writing makes and issues or purports to make and issue any official fatwa on any question relating to the Hukum Syarak shall be guilty of an offence and shall be liable, on conviction, to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both.
Provided that this section shall not apply to the Majlis or to any person performing any duty under the powers conferred by the Administration of Muslim Law Enactment, 1963.
(2) The provisions of sub-section (1) shall not apply to the mere expression by any person of opinion on any question relating to Muslim Law or Malay Custom.
