Baitulmal

Section 48. Right of the Baitulmal can be sued.

(1) Any money which has accrued to the Baitulmal shall become a debt that is payable to the Baitulmal by-

(a)

any relevant executor of a will or administrator of an estate or any person who has guaranteed them;

(b)

any person who has taken possession, other than a person who. has lawfully purchased it and paid the purchase price or who has exercised his power over any portion of the estate but only to the extent of that portion;

(c)

any person who has taken possession of any part of the estate like a person who has been given the right to the estate which has been divided by order of the court;

(d)

any person who is indebted to any person who has died to the extent of the amount of the debt.

(2) Any decision given by a court against anyone or more of such persons as stated above shall not affect the claim against any others.
