Chapter VIII - Examination of Witnesses



Section 91. Secret examination.

(1) Secret examination shall be made with secret letter in which the Kadi writes down the name of the Plaintiff or the Prosecution and the matter which is claimed or accused, the name of the witness, identification, occupation, place of residence, in order to identify and elaborate on the witness clearly.

(2) The information is sealed in an envelope and then given to a person chosen to be the witness examiner. On being received and read by the witness examiner he shall write below the witness's name with the word "adil" if he found the witness adil and "not adil" if he found the witness not adil, signed and returned the letter to the Kadi.

(3) When the secret letter is returned to the Kadi and no "adil" word is given by the witness examiner of the witness, but a word having the meaning of "not adil" express or implied, the Kadi may require the Plaintiff or the Prosecution to produce other witnesses.

Explanation-

If the witness examiner writes that the witnesses are "not adil", or he could not determine their condition or their condition is undeterminable or writes Wallahu'Alam or the witness examiner do not write anything the Kadi shall not admit the evidence of the witnesses.
