PART III - CONSTITUTION OF SYARIAH COURTS APPOINTMENT OF OFFICERS AND THEIR JURISDICTION
Section 51. Officers and empowered to arrest without warrant and when to do so.
Any Religious Inspector, Penghulu, Ketua Kampung, Imam, Khatib, Pemeriksa Hal Ehwal Ugama and any Police Officer may arrest without a warrant-
(a) any Muslim against whom a reasonable complaint has been made or credible information has been received relating to offences under section 49 or a reasonable suspicion exists that he has been concerned in such offences:
Provided that after such arrest if made by officers other than a Religious Inspector;
(b) any Muslim who escapes after having been arrested under paragraph (a);
(c) any Muslim if in presence of any of the above mentioned officers commits an offence under section 50 of this Enactment and fails to furnish such officers with his name and residence in Malaysia or such officer has reasons to believe that the name and residence as furnished are false and that the purpose of the arrest is to ascertain his name and residence and therefore within twenty four hours from the time of arrest, exclusive of the time necessary for the journey, he shall be produced before the nearest court unless at any time before he is so produced his true name and residence have been ascertained in which case he shall inmmediately be released.
