PART V - OFFENCES



Section 94. Fornication.

(1) Any male Muslim who has sexual intercourse with a woman professing Islamic Religion who is, or whom he knows or has reason to believe to be, the wife of another man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of fornication and shall be liable on conviction before a competent court to imprisonment for a term not exceeding six months or to a fine not exceeding one thousand dollars.

Any woman convicted before a competent court of being a participator in the foregoing offence shall be liable to a term of imprisonment not exceeding six months or to a fine not exceeding one thousand dollars.

(2) A male Muslim who has sexual intercourse with a woman who is not the wife of some other man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of fornication and on conviction by a competent court shall be Iiable to imprisonment not exceeding six months or to a fine not exceeding one thousand dollars.

Any woman who is found guilty by a competent court of being a participator in the offence referred to in this sub­section shall be liable to a term of imprisonment not exceeding six months or to a fine not exceeding one thousand dollars.
