ENACTMENT No. 11 Of 1988 CONTROL AND RESTRICTION OF THE PROPOGATION OF NON-ISLAMIC RELIGIONS ENACTMENT 1988
PART I - PRELIMINARY
Section 2. Interpretation.
(1) In this Enactment, unless the context otherwise requires-
"Audio recording" means any material, including phonograph records, tapes, and laser discs, on which is recorded a recording of a human voice;
"Authorised Officer" means a public officer authorised under section 10 to exercise the powers of an authorised officer under this Enactment;
"Film" includes-
(a) a cinematograph film;
(b) a videotape; and
(c) a record, howsoever made, of a sequence of visual images, which is a record capable of being used as a means of showing that sequence as a moving picture;
"Non-Islamic Religion" means Christianity, Hinduism, Buddhism, Sikhism, Judaism, or any variation, version, form or offshoot of any of the said religions, and includes Qadyanism and Bahaism, or any creed, cult, sect, ideology, philosophy, or any system of Practices or observances, which has as one of its characteristics the worship of some spiritual or supernatural being or power, whether real or supposed, or which purports to have as its aim or one of its aims the attainment of spiritual enlightenment or spiritual existence, being a creed, cult, sect, ideology, philosophy, or system of practices or observances which is not recognised by the religion of Islam as belonging to it;
"Publication" means any book, magazine, pamphlet, leaf let, or any other reading material, whether printed, typed, handwritten, or otherwise produced, and any reproduction thereof by any means and includes any film or audio recording;
"Publicity Material" in relation to any publication, means any material, including a picture, photograph, poster, figure, handbill, slide, newspaper advertisement and any other form of advertisement, intended tp publicese the publication;
"State" means the State of Kedah Darulaman.
(2) For the purpose of this Enactment, a publication shall be held to be a publication concerning a non Islamic religion if-
(a) where the publication is other than a film or audio recording, it is or contains, or
(b) where the publication is a film, it is capable of reproducing visual images of the contents of, or
(c) where the publication is an audio recording, it contains a recording of a recitation of or from,
a book or text, or any part of a book or text, which to the followers or members of that religion is a holy or fundamental book, or one of the essential texts, of that religion, or if in essence it is a publication which-
(i) treats of the history, tenets, teachings, characteristics, fundamentals, observances, rites, rituals, virtues, dogmas, ordinances, or organisation, of that religion;
(ii) treats of any being, power, person, or thing worshipped or revered by the followers or members of that religion especially;
(iii) comprises stories, tales legends, fables or anecdotes based on, emanating from, or forming the basis of, that religion;
(iv) seeks to lead persons to any knowledge or source of knowledge concerning any of the matters mentioned in paragraphs (i), (ii) and (iii);
(v) seeks to pursuade, influence, coerce, or incite persons to become followers or members of that religion or to learn or inquire about that religion; or
(vi) possesses any combination of the characteristics mentioned in paragraphs (i) to (v).
(3) Notwithstanding that a publication is a publication concerning a non-Islamic religion by reason that it falls under paragraph (i), (ii) or (iii) of sub-section (2), it shall not form the subject of an offence under this Enactment if the publication as a whole is in the interest of the religion of Islam or of Muslims as Muslims.
