ENACTMENT NO. 2 OF 1966
KELANTAN COUNCIL OF RELIGION AND MALAY CUSTOM ENACTMENT, 1966

PART I - PRELIMINARY



Section 2. Interpretation.

In this Enactment unless the context otherwise requires-

(1) "Anak Mukim" means the persons permanently or habitually resident in any mukim masjid.

(2) "Fitrah" means the amount of rice payable under Hukum Shara annually by every Muslim.

(3) "Jumaah Ulama" means Jumaah Ulama appointed under this Enactment.

(4) " Majlis" means the Majlis Ugama Islam dan Adat Istiadat Melayu constituted by section 4 of this Enactment and, as regards matter prior to the coming into force of this Enactment, includes the Majlis Ugama Islam dan Adat Istiadat Melayu then existing.

(5) "Mosque" means a building erected or used or caused to be used for holding "Friday Prayer" and other ceremonies connected with Islamic Religion and includes a Surau used for holding "Friday Prayer".

(6) "Mukim" and "Mukim Masjid" means the area prescribed by the Majlis in accordance with this Enactment within which a mosque is situated, and shall not necessarily coincide with the area of any mukim under the Land Enactment.

(7) "Nazar" means an expressed vow which is in accordance with Hukum Shara' to do any act or to dedicate property for any purpose allowed by Hukum Shara'.

(8) Nazar 'Am" means a nazar intended wholly or in part for the benefit of the Muslim Community generally or part thereof, as opposed to an individual or individuals.

(9) "Pegawai Masjid" means the Imam Tua, Imam Muda, Khatibs and Bilals of a mosque, if any, for the time being.

(10) "President" means the President of the Majlis.

(11) "Secretary" means the Secretary to the Majlis appointed under Section 4.

(12) "Treasurer" means the treasurer to the Majlis appointed under section 4.

(13) "Vice-President" means Vice-President of the Majlis.

(14) "Wakaf 'Am" means a dedication in pepertuity of the capital and income of property for religious or charitable purposes recognised by Hukum Shara' and the property so dedicated.

(15) "Wakaf Khas" means a dedication in perpetuity of the capital of property for religious or charitable purposes recognised by Hukum Shara', and the property so dedicated, the income of the property being paid to persons or for purposes prescribed in the wakaf.

(16) "Zakat" means a levy on properties such as padi, gold, silver, cash, animal and trading properties or stocks; such a levy payable annually by a Muslim in accordance with Hukum Shara' and in accordance with the provisions of this Enactment.

All words and phrases used in this Enactment which are defined in the Laws of the Constitution of Kelantan shall have the meanings thereby assigned to them respectively.
