PART IV - GENERAL PROCEDURE



Section 25. Summary punishment for perjury in open Court.

(1) When a person is giving evidence on any matter in any judicial proceedings in Court whether criminal or civil, it shall be lawful for the Court to ask the witness to show cause forthwith or at a later date why he shall not summarily be punished for perjury and if the witness shall fail to show such cause, the Court may summarily pass sentence on the witness as if he has committed contempt of Court, with a fine of not exceeding two hundred ringgit or imprisonment for a term not exceeding one month or both.

(2) A person sentenced under the provisions of this section shall have the right of appeal as if the has been sentenced after a trial conducted under the provisions of the law relating to criminal procedure for the time being in force, and subject to the provision of subsection (3) of this section and to any other necessary modifications, the provisions of that law shall apply to any such appeal.


(3) A person who is sentenced under subsection (1) of this section by the Court shall, immediately after the sentence is passed, be informed of his right of appeal against the sentence.


(4) When the notice of appeal is given by a person who is sentenced under this section, the Court which ordered the sentence shall suspend the execution of the sentence, and shall release the person who has been sentenced by executing a personal bond.
