Section 50. Takzir as an alternative punishment to hudud where the evidence does not fulfill the conditions required to prove a hudud offence.

Where the accused cannot be made liable to a hudud punishment because the witnesses have withdrawn their testimonies as provided for in section 46 or because the accused has retracted his iqrar as provided for in section 48 or the evidence available does not satisfy the conditions required to prove a hudud offence, the accused may be liable to a takzir punishment; and the Court shall proceed to pass such punishment if there is sufficient evidence for that purpose.
