PART X - PROCEDURE IN CRIMINAL PROCEEDINGS



Section 190. Information of offences.

(1) Every information relating to the commission of an offence under this Enactment may be reported, whether orally or in writing to the office of the Religious Prosecutor.

(2) If the information is reported orally, the officer at the office of the Religious Prosecutor who is charged to receive information under this section, shall reduce such information into writing and read it over to the informant.

(3) Every information reported under this section shall either be signed by the informant or receive his thumb impression and if the informant is not present the officer receiving the report shall sign it.

(4) Having received the report, the officer shall immediately forward it to the Religious Prosecutor.

(5) If the information relates to the commission of a seizable offence under this Enactment, the Religious Prosecutor shall forward it to the Religious Inspector for investigation.

(6) If the information relates to the commission of offences or acts other than seizable offences under this Enactment, the Religious Prosecutor, shall determine whether the information shows that an offence under this Enactment has taken place which requires investigation to be conducted. If he finds that investigation must be conducted, he shall then forward the information to the Religious Inspector with a direction to investigate at the same time specifying, the section under which the offence is to be investigated.
