Section 50. Appointment of Imam.

(1) It shall be the duty of the Majlis upon learning of any vacancy or impending vacancy in the office of Imam Tua of any mosque to make inquiry for possible candidates for such appointment and those possible candidates who have qualifications in the opinion of the Juma'ah Ulama shall be eligible to stand as candidates for such election of Imam Tua.

(2) If there be only one candidate, votes shall be cast in an election and he shall not be proclaimed elected unless a majority of the voters present cast the votes in favour of such candidate. If no majority is had the appointment of such Imam Tua shall be deemed to be still vacant.

(3) An election for the appointment of Imam Tua shall be held in the mukim, for which all adult male Muslims ordinarily and continuously there resident within a period of three months immediately prior to the day of election shall be entitled to register as voters.

(4) For the appointment of Imam Muda, the Juma'ah Ulama shall conduct an election and recommend to the Majlis the name of the candidate who is most fit and proper for such appointment.

(5) The Majlis, on being satisfied that any candidate has been duly elected in the manner aforesaid, shall submit his name to His Highness the Sultan with a recommendation that he be appointed to fill the vacancy in question.

(6) In the absence of Imam Tua due to death, leave, illness or otherwise, the Imam Muda shall appointed to act as Imam Tua. If he shall decline the appointment or if there be no Imam Muda, the Majlis may appoint any suitable person to act in that behalf.

(7) Every person appointed to be an Imam shall receive a Tauliah under the signed manual and seal of His Highness the Sultan.

Provided that for the purpose of election of Imam Tua in pursuance of this section the number of persons casting votes in a particular election shall not be less than one-half of the number of registered voters in that particular mukim.
