Section 43. When search warrant may be issued.

(1) Where-

(a) any Court has reason to believe that a person to whom a summons under section 41 has been or might have been addressed will not or would not produce the property or document as required by such requisition; or

(b) such property or document is not known to the Court to be in the possession of any person; or

(c) the Court consides that for the purposes of justice or of any inquiry, trial or other proceeding under this Enactment will be served by a general search or inspection.

(d) a Kadi having been satisfied on a written information given to him as a declaration and after making an inquiry as he thinks necessary hsa reasons to believe that an offence has been committed in any place,

the Court may issue a search warrant and the person to whom such warrant is directed may search and inspect in accordance therewith and with the provisions hereinafter contained.

(2) A search warrant shall ordinarily be directed to the Penyelia Agama and to some other officers to be designated by name therein, and all or any of such officers may execute such warrant.

(3) The Court issuing a search warrant may direct it to the Chief Police Officer of the State and to some other officers to be designated by name therein or to any person or persons by name, not being a Penyelia Agama or Police Officers, and all or any one or more of such Police Officers or persons may execute such warrant.
