Section 39. Matters not provided for.
In matters of practice and procedure in criminal proceedings, not expressly provided for in this Enactment or any rules made thereunder, the Court shall have regard to the avoidance of injustice and the convenient dispatch of business and may have regard to the practice and procedure obtaining in the Civil Courts in criminal proceedings.
