PART IX - OFFENCES.



Section 164. Religious books contrary to Religion.

(1) Whoever prints, publishes, sells, exhibits either for sale or for free exhibition in any manner whatsoever, circulates or distributes any book, magazine, document or writing containing instruction, fatwa or ruling contrary to the four mazhab or to any fatwa that has been lawfully issued in the State shall be guilty of an offence and shall on conviction be liable to a fine not exceeding five hundred ringgit or to imprisonment for a term not exceeding six months or to both.

(2) Whoever has in his control, custody of possession books, magazines, documents or writings referred to in subsection (1) if found in circumstances which may give reasons to suspect that such books, magazines, documents and writings are to be circulated, distributed or to be sold it shall for the purpose of circulation, distribution or sale, be presumed that they are in his control, custody or possession.

(3) In the absence of any other evidence to the contrary if five or more of such books or magazines or five or more sheets of such documents or writings carrying similar contents are found they shall be sufficient evidence to raise such suspicion as is required under subsection (2).

(4) The Court shall make an order of forfeiture in respect of all books, magazines, documents and writings referred to in subsection (1) and (2) with a, direction that they be destroyed or with whatever direction as may be appropriate whether or not there shall be prosecution of any person for any offence.
