SYARIAH COURTS ENACTMENT 1992

PART I - PRELIMINARY



Section 2. Interpretation.

(1) In the Enactment, unless the context otherwise requires-

"Syariah Appeal Court Judge" means a Judge of Syariah Appeal Court appointed under section 6 (1);

"Syariah Court" means Syariah Lower Court, Syariah High Court, or Syariah Appeal Court, as the case may be, constituted under section 4;

"Syariah High Court Judge" means a Judge of Syariah High Court appointed under section 6 (1);

"Syariah Lower Court Judge" means a Judge of Syariah Lower Court appointed under section 8 (1);

"Syarie Judge" or "Judge" means a Syarie Judge appointed under section 6 (1);

"Chief Syarie Judge" means Chief Syarie Judge appointed under section 6 (1);

"Chief Syarie Prosecutor" means officer appointed under section 23 (1);

"Majlis" means Majlis Ugama Islam Sabah constituted under the Administration of Muslim Law Enactment 1992;

"Minister" means Minister charged with the responsibility for administration of Muslim affairs in the State of Sabah;

"State" has the same meaning as assigned thereto by the Administration of Muslim Law Enactment 1992;

"Muslim" has the same meaning as assigned thereto by the Administration of Muslim Law Enactment 1992;

"State" means the State of Sabah;

"religious Enforcement Officer" means an officer appointed under section 23 (4) and include the Chief Religious Enforcement Officer and Assistant Religious Enforcement Officer;

"Syarie Lawyer" means a person admitted as a Syarie Lawyer under section 24.

(2) All words and expressions used in this Enactment and not defined therein but defined in the Interpretation and General Clauses Enactment 1963 shall have the same meanings assigned thereto respectively to the extent that they are not inconsistent with Hukum Syarak.

(3) If any doubt or uncertainty arises when interpreting word and expression relating to Hukum Syarak it shall be the discretion of the Syariah Court to decide the meaning of the said word or expression.
