PART IV - MISCELLANEOUS



Section 27. Savings and transitional.

(1) All regulations, rules, proclamations, orders, notices, forms, authorizations letters and appointments issued or made under the previous Enactment in relation to matters provided for in this Enactment shall remain in force, in so far as they are not inconsistent with this Enactment, until revoked or replaced by regulations, rules, proclamations, orders, notices, forms, authorizations letters or appointments issue or made under this enactment.

(2) Any matter pending before the commencement of this Enactment before the Syariah Subordinate Court, the Syariah High Court or the Syariah Appeal Court established under the previous Enactment shall, on such commencement, be heard or continued and disposed of by the Syariah Subordinate Court, the Syariah High Court or Syariah Appeal Court, respectively, established under this Enactment.

(3) Where a mattes was pending before the Syariah Subordinate Court before the commencement of this Enactment and the Syariah Subordinate Court established under this Enactment does not have jurisdiction to hear and dispose of the matter under this Enactment, then, notwithstanding section 12 of this Enactment such matter shall be heard or continued and disposed of by the Syariah Subordinate Court established under this Enactment as if the Syariah Subordinate Court established under this Enactment had been conferred jurisdiction to hear or continue and dispose of such matter
