ENACTMENT NO. 3 OF 2002 CONTROL OF ISLAMIC RELIGIOUS SCHOOLS (MALACCA) ENACTMENT 2002
PART IV - BOARD OF MANAGEMENT
Section 12. Instrument of management, establishment of Board and its membership.
(1) Subject to the provisions of this Enactment, every religious school shall have an instrument of management.
(2) Every instrument of management shall provide for the constitution of a Board of Management of an Islamic Religious School, with a chairman, for the management of the religious school in a manner not inconsistent with this Enactment.
(3) Subsection (1) shall not apply to a religious school established by the State Government which shall be managed and maintained in such manner as specified by the Department.
(4) Every Board shall consist of at least seven persons who shall hold such offices as may be necessary for such religious school and have such powers, functions and duties as prescribed by the instrument of management.
(5) The head teacher or principal of a religious school shall be appointed the Secretary of the Board.
(6) Subject to the other provisions of this Enactment and in particular the provisions as to exemption, every religious school shall be managed and maintained in accordance with its instrument of management.
(7) Every instrument of management shall be made, amended or revoked in such manner as may be prescribed.
