ENACTMENT NO. 13 OF 1992 ADMINISTRATION OF ISLAMIC LAW ENACTMENT 1992
PART II - THE MAJLIS UGAMA ISLAM NEGERI SABAH AUTHORITY IN RELIGIOUS MATTERS
Section 38. The Islamic Consultative Committee.
(1) There shall be an Islamic Consultative Committee to be known as "Majlis Fatwa Negeri Sabah" (hereinafter in his section referred to as "the Committee").
(2) The Committe shall consist of -
(a) the Mufti, as the Chairman;
(b) two members of the Majlis nominated by the Majlis, and
(c) not less than three fit and proper persons to be appointed by the Majlis from a lecturer or religious teacher in institution of Islamic study in Sabah including an officer of the Majlis or Islamic Religious Affairs Department of the State of Sabah to be appointed by the Majlis, who shall be the Secretary.
(3) The persons who immediately before the coming the force of this Enactment were appointed members of the Legal Committee established under section 10 of the Administration of Muslim Law Enactment 1977 shall, subject to this Enactment be deemed to have been nominated or appointed to be members of the Committee and shall continue to be members until the expiry of his period of appointment.
(4) Of the persons referred to in subsection (3), two who are members of the Majlis shall be deemed to have been nominated under paragraph (b) of subsection (2) and the rest shall be deemed to have his appointed under paragraph (c) of that subsection.
(5) Whenever the Mufti proposes to make a fatwa under section 25 he shall call a meeting of the Committee for the purpose of assising the proposed fatwa.
(6) Before the Mufti makes a fatwa, he may cause such studies a search to be conducted and a working paper prepared.
(7) The majlis may, with the approval of the Minister, make orders providing for the following-
(a) the procedure of the Committee; or
(b) allowance payable to the members of the Committee.
