PART III - CONSTITUTION OF SYARIAH COURTS APPOINTMENT OF OFFICERS AND THEIR JURISDICTION
Section 48. Prosecution.
(1) Subject to subsections (2) and (3) prosecution shall be conducted by-
(a) Religious Prosecutor;
(b) Deputy Public Prosecutor within the meaning of the Criminal Procedure Code;
(c) a police officer; or
(d) the complainant.
(2) Notwithstanding subsection (3) the complainant may only conduct the prosecution of offences in which he is himself the complainant if the other prosecuting officers will not prosecute them.
(3) Any prosecuting officer having an interest in any case which he is to prosecute, shall withdraw from prosecuting it and hand it over to another prosecuting officer.
