PART III - SYARIAH COURTS
Section 43. Appointment of Judges.
(1) The Chief Syarie Judge and Syariah High Court Judge shall be appointed by His Royal Highness the Sultan on the advice of the Majlis.
(2) Before tendering its advice on the appointment of a Syariah High Court Judge, the Majlis shall refer to the Chief Syarie Judge.
(3) A person shall be qualified for appointment under subsection (1) if-
(a) he is a male Muslim;
(b) he ia a citizen; and
(c) for a period of not less than ten years preceding his appointment, he has been practising as a Peguam Syarie in any of the Syariah Courts or as a member of the Syariah Courts or is learned in Islamic legislation.
(4) For the purpose of subsection (3) a person who before the coming into force of this Enactment has been practising as an advocate in the Syariah Courts shall be deemed to be a Peguam Syarie and a person who has served as a Kadi Besar, Kadi or Prosecutor in the Syariah Courts shall be deemed to be a member of the Syariah Courts.
(5) All appointments under this section shall be published in the Gazette.
