PART XI - DISCOVERY
Section 85. Discovery of documents and facts
(1) The Court may, where necessary and upon such terms as it thinks just, order any party—
(a) to state on oath, orally or by affidavit what document he has or has had in his possession or power relating to the matters in question, or whether he has or has had in his possession or power any specified document or documents or class of documents and, in either case, the present whereabouts of any documents formerly, but not now, in his possession or power; or
(b) to produce any document in his possession or power.
(2) If the party is a body, whether incorporated or otherwise, an officer of that body may be ordered to comply with the order or direction of the Court in respect of discovery of any documents.
(3) The Court may stay the proceedings pending compliance of the order or direction of the Court under this section.
