PART IV - GENERAL PROCEDURE



Section 24. Evidence.

(1) The Court shall observe all the provisions of Hukum Syarak relating to the number, status or quality of witnesses or evidence required to prove any fact, save as aforesaid, the Court shall have regard to the law of evidence for the time being in force in the State and shall be guided by the principles thereof but shall not be obliged to follow it strictly. If there is any inconsistency between the principles in the law of evidence and the Hukum Syarak, the Hukum Syarak shall prevail.

(2) The Court shall have power to administer oaths and affirmations, in accordance with Form I and Form II in the Second Schedule. Evidence shall ordinarily be given on oath but on special grounds the Court may dispense with and oath and admit evidence on affirmation.
