Section 32. Summary punishment for perjury.

(1) When a person is giving evidence on any matter in any judicial proceedings in Court whether criminal or civil, it shall be lawful for the Court to ask the witness to show cause forthwith or at a later date why he should not summarily be punished for per jury and if the witness shall fail to show such cause, the Court may summarily pass sentence on the witness as if he has committed contempt of Court, with a fine of not exceeding five hundred ringgit or imprisonment for a term not exceeding three months or both.

(2) A person sentenced under the provisions of this section shall have the right of appeal as if he has been sentenced after a trial conducted under the provisions of the law in force relating to criminal procedure for the time being in force, and subject to the provision of sub-section (3) of this section and to any other necessary modifications, the provisions of the law shall apply to any such appeal.

(3) A person who is sentenced under sub-section (1) of this section by the Court shall, immediately after the sentence is passed, be informed of his right of appeal against the sentence.

(4) When the notice of appeal is given by a person who is sentenced under this section, the Court which ordered the sentence shall suspended the execution of the sentence, and shall release the person who has been sentenced on his executing a personal bond.
