Section 6. Appointment of Judges.
(1) The yang di-Pertua Negeri may, on the advice of the Majlis, appoint a Chief Syarie Judge, Judges of the Syariah Appeal Court, and Judges of the Syariah High Court.
(2) Before it submits its advice relating to the appointment of a Judge of the Syariah Court of Appeal or Judge of the Syariah High Court, the Majlis shall refer to the Chief Syarie Judge.
(3) A person is qualified to be appointed under subsection (1) if -
(a) he is a citizen; and
(b) he -
(i) has, for a period of not less than seven years prior to his appointment, been a Judge of a Syariah Court or Kadi or Registrar or Syarie Prosecutor of a State or sometimes one and sometimes another; or
(ii) is a person learned in Hukum Syarak.
(4) A person who, before the commencement of this Enactment, held office as Kadi Besar or Kadi under section 45(2) of the Administration of Muslim Law Enactment, 1977 and had executed judicial function shall, on the commencement of this Enactment, be qualified to hold office of Chief Syarie Judge or Judges of the Syariah High Court, as the case may be.
(5) All appointments under this section shall be notified in the Gazette.
