PART XXVII – POWERS OF JUDGE AND REGISTRAR



Section 197. Reference and variation of order.

(1) The Registrar may in his discretion refer to the Judge for his decision any matter coming before him for decision whether under this Part or otherwise.

(2) Any order or decision made by a Registrar, whether under this Part or otherwise, may be set aside or varied by a Judge either of his own motion or on the application of any person affected thereby, and he may make such order as may be just :

Provided that except for special reason, the Judge shall not consider any such application unless made within 4 days after the applicant knew of the order or judgment complained against:

Provided further that no such application shall have the effect of staying the proceedings under the order or decision and no order of the Judge reversing the same shall invalidate anything lawfully done thereunder unless the Judge shall otherwise order.
