PART III - PRODUCTION AND EFFECT OF EVIDENCE CHAPTER 7 - WITNESSES
Section 86. Number of witnesses.
(1) Evidence in a case of zina which carries a penalty of hudud is inadmissible except where it was witnessed by four male witnessess.
(2) A claim by a person known to be rich that he has become a pauper is inadmissible unless it is corroborated by three male witnesses.
Explanation - Admission of being a pauper in the collection of zakat and of being a pauper which relinguishes the burden of repaying and maintenance of family and wife is inadmissible unless it was witnessed by the three male witnesses.
(3) In the matter of sighting the moon, the evidence of one male person who is adil is admissible.
(4) Evidence of a male person in the following circumstances -
(a) evidence of a teacher in a case where school children are involved;
(b) evidence of an expert in the valuation of detective goods;
(c) evidence of approving and rejecting witnesses;
(d) notification concerning the dismissal of a representative;
(e) notification concerning shoddy goods, is admissible.
(5) Evidence of a female is admissible in matters which are usually seen by women.
ILLUSTRATION
Evidence of a female who breast-feeds a child a mid-wife in matters relating to menstruation, birth, breast-feeding and immorality of a women is admissible.
(6) In matters other than those mentioned aboved, evidence shall be given by two male or one male and two female witnesses.
