PART XI - OFFENCES
Section 118. Incest.
(1) Any person has sexual intercourse with a person whom he is, and knows or has reason to believe that he is, either absolutely or conditionaIIy forbidden by Muslim Law to marry, commits incest.
(2) Any person who commits incest with another person whom he is, and knows or has reason to believe that he is, absolutely forbidden to marry under Muslim Law shall be liable on conviction-
(a)where the first mentioned person be a male, to imprisonment for a term not exceeding five years; and
(b)where the first mentioned person is a female, to imprisonment for a term not exceeding oneyear.
(3) Any person who commits incest with another person whom he is, and knows or has reason to believe that he is, conditionally forbidden to marry under Muslim Law shall on conviction be liable to imprisonment for a term not exceeding six months or to a fine not exceeding two hundred and fifty dollars.
(4) Offence under this section shall be tried in the Sessions Court.
