PART VI - GENERAL EXCEPTIONS



Section 45. Act of a person who is compelled by threats.

(1) Nothing is an offence if it is done by person who is compelled to do it by threats of such a nature as to reasonably cause that person to believe, at the time of doing it, that instant death to that person will otherwise be consequence.

(2) The exception provided for in subsection (1) shall not apply if the person doing the act placed himself, of his own accord, in the situation by which he became subject to such constraint.


Explanation 1 - A person who, of his own accord, or by reason of a threat of being beaten, joins a deviationist religious group knowing their beliefs is not entitled to the benefit of this exception on the ground of his having been compelled by his associates to do anything that is an offence by law.

Explanation 2 - A person seized by a religious extremist group and forced by threat of instant death to do a thing which is an offence by law is entitled to the benefit of this exception.
