ENACTMENT NO. 7 OF 1983 ISLAMIC FAMILY LAW (NEGERI SEMBILAN) ENACTMENT 1983
PART X - GENERAL
Section 134. Power to make rules.
(1) The Yang di-Pertuan Besar, on the advice of the Maljis, may by notification in the Gazette make rules regulating the practice and procedure in all matrimonial proceedings under this Enactment as he considers expedient and rules to fix and regulate the fees and costs payable in all such proceedings; subject thereto all proceedings under this Enactment shall be regulated by the practice and procedure of the Court laid down by the Administration Law, to the extent that such practice and procedure are not inconsistent with this Enactement.
(2) In matters of practice and procedure in matrimonial proceedings not expressly provided for in this Enactment or in any rules made under this Enactment or in the Administration Law, the Court may adopt such practice and procedure as may seem proper for the avoidance of injustice and the disposal of the matters in issue between the parties.
(3) The Yang di-Pertuan Besar, on the advice of the Majlis, may by notification in the Gazettemake rules for the purpose of this Enactment and, without prejudice to the generality of the foregoing, such rules may provide for-
(a) the manner in which the Registrars of Muslim Marriages, Divorces and Ruju' shall exercise the powers conferred on them by tis Enactment;
(b) the forms of the Marriage, Divorce and Ruju' Registers and of the certificates of marriage, divorce and ruju' and the mode in which they are to be kept;
(c) the supply and safe custody of the Marriage, Divorce and Ruju' Registers, the Registrars' notebooks and declarations made for the purposes of this Enactment.
(d) the preparation and submission of returns of marriages, divorces and ruju' registered under this Enactment;
(e) the forms of any certificate, notice, or other document required for the purpose of implementing this Enactment;
(f) the making of searches and the giving of certified copies;
(g) the fees chargeable for the purposes of this Enactment;
(h) the punishment for any breach or failure to comply with any rules made under this Enactment; and
(i) other matters for the purpose of carrying out this Enactment.
