Section 176. Application for judgment debtor summons.

(1) Where a judgment of the Court is for the payment of money, the judgment creditor who is entitled to enforce the judgment may require the judgment debtor liable under the judgment to appear in Court to be examined orally as to his capacity of paying or settling the judgment debt and to get any property which may be used for such payment.

(2) An application requesting a judgment debtor to appear under subsection (1) shall be made by filing a request in Form MS 42, signed by the applicant or his Peguam Syarie.

(3) Where a judgment has been given against two or more persons, the judgment creditor may require the judgment debtor summons to be issued against each or any of the persons liable under the judgment.
