Section 242. Recording of evidence before trial.

(1) Where the Court is satisfied that the evidence of any party or witness should be taken before the date of the hearing, the Court or any Judge ordered by the Court may take the evidence from any such party or witness at such place as it thinks fit and the evidence so taken may be used at the trial.

(2) Notice that evidence will be taken under subsection (1) shall be served on the other party not less than two days before the date the evidence is to be so taken and the other party may take part in such proceedings.
