ENACTMENT NO. 4 OF 1994 CRIMINAL PROCEDURE (SYARIAH) CODE 1994
PART I - PRELIMINARY CHAPTER 1
Section 2. Interpretation.
(1) In this Code unless the context otherwise requires-
"Administration Enactment" means the Administration of Islamic Law Enactment 1992;
"Chief Syariah Judge" has the same meaning assigned thereto in the Administration Enactment;
"Chief Syariah Prosecutor" has the same meaning ssigned thereto in the Administration Enactment;
"Complaint" means the allegation made orally or in writing to a Syariah Judge with a view to his taking action under this Code that some person whether known or unknown has committed or is guilty of an offence;
"Court" or "Syariah Court" has the same meaning assigned thereto in the Administration Enactment:
"Deputy Public Prosecutor" has the same meaning assigned thereto in the Criminal Procedure Code; .
"1965 Enactment" means the Administration of Muslim Law Enactment 1965;
"Majlis" has the same meaning assigned thereto in the Administration Enactment;
"Mufti" has the same meaning assigned thereto in the Administration Enactment;
"non-seizable offence" means an offence punishable with imprisonment for less than one year or with fine only;
"offence" means any act or omission made punishable by any written law prescribing offences that may be committed by Muslims and for which the Syariah Court has jurisdiction;
"peguam syarie" has the same meaning assigned thereto in the Administration Enactment;
"President" has the same meaning assigned thereto in the Administration Enactment;
"prosecutor" means the Chief Syariah Prosecutor, and includes a Syariah Prosecutor and any person authorized under this Code to act on behalf of the Chief Syariah Prosecutor;
"Registrar" or "Registrar of the Syariah Court" means the Chief Registrar of the Syariah Appeal Court, the Registrar of the Syariah High Court, or Assistant Registrar of the Syariah Subordinate Court, as the case may require;
"Religious Enforcement Officer" or "Assistant Religious Enforcement Officer" has the same meaning assigned thereto in the Administration Enactment"
"seizable offence" means an offence punishable with imprisonment for one year or more;
"summon" includes notice for the appearance of any person in Court;
"Syariah Judge" or "Judge" means a Judge appointed under section 41(1) and 42(1) of the Administration Enactment and for the purpose of signing Court documents shall include the Registrar;
"Syariah Prosecutor" has the same meaning assigned thereto in the Administration Enactment;
"witness" does not include an accused person;
"youthful offender" means an offender under the age of eighteen years;
(2) All words, expressions, definitions and terms 'used in this Code and not specially defined shall be deemed to have the meaning given to them in the Interpretation Acts 1948 and 1967 (Consolidation and Revision - 1989).
(3) If any question or dispute arises as to the interpretation of the words, expressions or terms relating to Hukum Syara', the Court trying the case shall have jurisdiction to give the definition to such words, expressions or terms.
