Section 94. Power of Court to restrain a child from being taken out of Malaysia.

(1) The Court may, on application by the father or mother of the child-

(a) if the decision in a proceeding between a husband and wife is still pending; or

(b) if, by an agreement or by an order of Court which orders the mother or father alone shall have custody of the child whilst the other is not given the

custody;

issue an order restraining the other party from taking the child out of Malaysia or the Court may allow the child to be taken out of Malaysia without conditions or subject to any conditions the Court deems fit to impose.

(2) The Court may on the application of a person having an interest issue out an order restraining a person other than the person having custody on the said child from being taken out of Malaysia.

(3) Failure by any person to comply with any order made under this section is a contempt of Court and on conviction he shall be imprisoned for a period not exceeding three months.
